Terms of Service

1. What Torckit is

Torckit is a software platform that helps freelance designers turn client conversations into interactive proposals, contracts, and offers, using AI assistance. Torckit is a tool provider — it is not a law firm and does not provide legal advice.

2. Your account

• You must be at least 18 years old and provide accurate account information.
• You are responsible for keeping your login credentials secure and for all activity under your account.
• Notify us promptly at torckit.hq@gmail.com if you suspect unauthorised access.

3. Subscriptions, billing and taxes

• Torckit offers a free tier and paid subscription plans (billed monthly or annually) processed through our payment partner, Razorpay.
• Paid plans renew automatically at the end of each billing period until cancelled. You authorise us (via Razorpay) to charge your selected payment method on each renewal.
• Prices are inclusive of applicable taxes unless stated otherwise. You are responsible for any taxes arising from your own use of the documents you create.
• Cancellation and refunds are governed by our Refund & Cancellation Policy.

4. Your content and the documents you create

• You retain ownership of the content you upload (recordings, notes, client details) and of the proposals and contracts you generate.
• You grant Torckit a limited licence to process your content solely to operate and provide the service (including via the AI and infrastructure providers listed in our Privacy Policy).
• You are solely responsible for reviewing every document before you send, sign, or rely on it, and for ensuring it is accurate, complete, and legally suitable for your situation.

5. AI-generated output

Proposals, contracts, and other documents are generated with the help of AI and are provided as editable drafts. They may contain errors or omissions and do not constitute legal, tax, or financial advice. You should review — and where appropriate have a professional review — any document before use. Torckit is not responsible for the legal validity or enforceability of documents you create or send.

6. Acceptable use

You agree not to misuse Torckit, including by using it to send spam, infringe others’ rights, upload unlawful content, attempt to breach security, reverse-engineer the service, or resell it without permission.

7. Intellectual property

The Torckit platform, its software, design, branding, and templates (excluding your content) are owned by Torckit and protected by applicable IP laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the service.

8. Third-party services

Torckit relies on third-party providers (for hosting, transcription, AI generation, email, and payments). Your use of the service is also subject to those providers processing data as described in our Privacy Policy. We are not responsible for third-party outages beyond our reasonable control.

9. Disclaimers

The service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or that AI output will meet your requirements.

10. Limitation of liability

To the maximum extent permitted by law, Torckit will not be liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill. Our total aggregate liability arising out of or relating to the service will not exceed the amount you paid to Torckit in the twelve (12) months preceding the claim.

11. Termination

You may stop using Torckit and delete your account at any time. We may suspend or terminate access if you breach these Terms or use the service in a way that risks harm to others or to the platform. On termination, your right to use the service ends; sections that by their nature should survive (e.g. IP, disclaimers, liability) will survive.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date, and where appropriate we will notify you. Continued use after changes means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of India, and you agree to the exclusive jurisdiction of the competent courts located in India, without regard to conflict-of-law principles.
